We believe that this action contravenes the processes laid out in the Biosecurity Act 2015 and is therefore unlawful.

We understand that this is a traumatising time for you. We want to assist you as much as we can to help you achieve the outcome of no longer being detained unlawfully by Victoria Police, the Victorian Government and the Deputy Chief Health Officer.
We also wanted to summarise our legal strategy.
Our legal strategy is designed and aimed at seeking compensation for you for being unlawfully detained at your home premises starting from 3:30pm on 4 July 2020.
This action is called false imprisonment.
The tort of false (or unlawful) imprisonment is committed when a person confines another person intentionally or even negligently within a fixed area without legal authority. The right to freedom from interference with personal liberty is regarded as a fundamental, legal right. The sole defence to the tort of false imprisonment is the defence of legal authority.
The four common situations where public authorities detain people lawfully are as follows:
1. A person sentenced by a Court to serve a term of imprisonment for committing an offence or offences, or who has been arrested on suspicion of committing an offence, but has been refused bail;
2. Police arresting suspected offenders;
3. Hospitals or doctors detaining people who are mentally ill;
4. Immigration detention.
Unfortunately, the Victoria Police, the Victorian Government and the Deputy Chief Health Officer have detained you in the absence of you being suspected of committing an offence.
Both the Victorian Public Health and Wellbeing Act 2008 and the Commonwealth Biosecurity Act 2015 do not allow for this despicable action to be taken against.
You cannot be detained before being individually identified as a serious public health risk and where you individually pose a significant risk of contagion. Usually this happens through the process of being individually issued a biosecurity control order or direction to that effect. If you then fail to comply with that order or direction, then there may be an arguable case for detainment.
Unfortunately, the powers that be have failed to comply with their own processes and have put you at a significant risk of harm.
We also say that there are serious breaches of the Charter of Human Rights and Responsibilities Act 2006, which state clearly that a person must not be treated in a cruel, inhumane and degrading way and that a person has a right to move freely within Victoria.
The class action applies to everyone who has been impacted by the following directives:
Your participation in this class action will not cost you anything upfront. We are representing you on a no-win no-fee basis. We are keenly aware of your difficult circumstances. However, we will be seeking community donations and other funding in due course. We would like to take this action as urgently as possible to assist you as quickly as possible.
