and transcribed as simply as possible the Process currently underway to see the people get the President they voted for. It is a little involved, as are the possibilities of the journey itself, even so it may provide a useful map.
(Full gratitude to Dave, always a great mind for honing in on and presenting essentials. The guy has a gift ... and ... having faffed around the pool's edge enough ... let's plunge.)
It doesn't matter (in the long run) how State Legislatures certified their vote, since a certification that came from a fraudulent vote is open to be legally contested, once certified.
Trump's Legal Team (Giuliani, Ellis, Wood etc) are currently presenting evidence to 6 state legislatures who will, having heard it all, elect Voting Electors (on Dec 8th Safe Harbor Day, the day all legal proceedings must be resolved by, and all Electors chosen) who will then go forward to vote on Electoral College Vote Day Dec 12th.
What Electors are chosen, who they will vote for (Trump or [B]iden) is what is important and not state certification.
An important part of the legal team's argument to members of the State Legislatures, who may feel a misplaced sense of loyalty to state laws concerning the election (which may favor the heavily contested 'popular vote') is to clarify that Article 2 of the Constitution supersedes all state laws in the matter (which would be confirmed by the Supreme Court should it go there) an article that leaves them entirely free to follow their own consciences in the matter of voting which Electors ought to represent the states they serve.
Electors can vote for Trump or [B]iden. The hope (of the nation) being that the evidence being expertly presented and objectively appraised, Electors will be chosen that genuinely reflect the will of real voters (the people) in each state.
Multiple lawsuits have been filed and (I gather) 6 states are being contested.
Wisconsin, Arizona, Michigan, Nevada, Georgia and Pennsylvania.
Electors chosen for Trump for any combination of 3 of these states puts him over the needed 270 (except Nevada and Wisconsin and any other). From any four or more, of course, puts him over.
However once the Electors have been chosen (Dec 8th) they have to be certified by the governor of each state, (along with the Secretary of State). The governor can decide whether to allow or block an Elector from voting (on the 12th). If sufficient Electors are blocked so that neither party benefits (in getting passed the 270 mark) the matter is placed before the House of Representatives to vote on.
Dave reminds us here that altho the dems have a seat majority in the House, what matters here is the state majority and republicans have that.
However, let us say that all the needed Electors get to vote on Dec 12th to give a required result. There is a further filter (for that result) to go through (in case of a blatantly unconscionable Electoral College Vote) of Congress itself. The EC vote is sent to Congress to look into any irregularities, who will then vote to block or allow it.
The only thing to add is that the Supreme Court can pickup and take over any case currently underway and are not limited by the Dec 8th deadline. (Possibly giving an election deciding ruling ...?)
